Lifetime Limited WarrantyThis Lifetime Limited Warranty (the
“Warranty”) is issued by
KM Enterprises LLC, a Hawaii corporation, doing business as
AquaRev Water (the
“Company”,
“AquaRev”,
“we”,
“us”, or
“our”), to the original commercial customer (“
Customer” or “
you”) that has purchased, leased, or is otherwise authorized to use an AquaRev Water hydrodynamic cavitation device (the
“Device”).
1. Scope of Lifetime WarrantySubject to the terms, conditions, exclusions, and limitations set forth herein, AquaRev warrants that the
core mechanical components of the AquaRev Water Device will be free from defects in materials and workmanship
for the lifetime of the Device, provided the Device:Remains in continuous commercial service at the original installation location, andIs operated, maintained, and serviced strictly in accordance with AquaRev’s published specifications, installation guidelines, and maintenance requirements.For purposes of this Warranty,
“Lifetime” means the functional service life of the Device as determined by AquaRev, not the lifetime of the Customer, facility, or property.
2. Covered ComponentsThis Lifetime Warranty covers failure due to defects in materials or workmanship of the following components (collectively, the
“Covered Components”):Stainless steel housing and structural bodyInternal cavitation chamberInternal fixed mechanical assemblies integral to the cavitation processAt AquaRev’s sole discretion, warranty coverage shall be satisfied by
repair, refurbishment, or replacement of the affected Covered Component.
3. Excluded Components and ConsumablesThis Warranty
does not cover the following items, which are expressly excluded:Gaskets, seals, O-rings, fasteners, and fittingsExternal piping, valves, unions, or adaptersSensors, meters, controllers, or monitoring devices not manufactured by AquaRevCosmetic wear, surface discoloration, or normal corrosion consistent with commercial pool environmentsDamage resulting from debris, scaling, calcium buildup, or chemical imbalanceExcluded components may be covered under separate limited warranties, if applicable.
4. Conditions of Warranty CoverageThis Warranty is
strictly conditional upon compliance with all of the following:
Proper Installation – Installation must be performed by a qualified professional in accordance with AquaRev’s installation documentation.
Proper Operation – The Device must be operated within AquaRev’s published flow-rate, pressure, and water chemistry parameters.
Water Chemistry Compliance – Pool or spa water must be maintained within industry-accepted ranges for pH, alkalinity, calcium hardness, and total dissolved solids.
No Unauthorized Modifications – The Device must not be altered, modified, welded, machined, or repaired by any person not expressly authorized by AquaRev.
Continuous Service – The Device must remain installed and in active use; removal from service for extended periods may void coverage.Failure to meet any of these conditions shall render this Warranty
null and void.
5. Warranty ExclusionsThis Warranty does
not apply to damage or failure resulting from:Improper installation or removalMisuse, abuse, neglect, or negligenceOperation outside AquaRev specificationsImproper chemical treatment or water imbalanceFreezing conditions, flooding, fire, or acts of GodElectrical surges or external mechanical damageUse in applications other than commercial aquatic systems unless expressly approved in writing
6. Remedies and LimitationsAquaRev’s sole obligation and Customer’s exclusive remedy under this Warranty shall be limited to
repair or replacement of the defective Covered Component.AquaRev shall
not be responsible for:Labor costs associated with removal or reinstallationFreight, shipping, or transportation costs unless expressly authorized in writingDowntime, loss of use, loss of revenue, or loss of profitsIncidental, consequential, indirect, or special damages of any kindSome jurisdictions do not allow limitations on incidental or consequential damages; in such cases, the above limitation may not apply.
7. Relationship to Lease or Service AgreementsIf the Device may be provided under a lease, subscription, or service agreement:This Warranty applies
only while the agreement remains active and in good standingNon-payment or default of the agreement immediately suspends warranty coverageTitle to the Device, if retained by AquaRev or its financing partner, shall not affect warranty applicability while contractual obligations are met
8. Warranty Claim ProcedureTo initiate a warranty claim, Customer must:Notify AquaRev in writing at
water@aquarevwater.usProvide proof of installation date and serial numberProvide documentation of operating conditions and water chemistry records upon requestAllow AquaRev reasonable access to inspect the DeviceAquaRev reserves the right to require return of the Device or affected component for evaluation.
9. TransferabilityThis Lifetime Warranty is
non-transferable and applies only to the original Customer and original installation site, unless AquaRev expressly agrees otherwise in writing.
10. Disclaimer of Other WarrantiesEXCEPT AS EXPRESSLY SET FORTH HEREIN, AQUAREV MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
11. Governing LawThis Warranty shall be governed by and construed in accordance with the laws of the
State of Hawaii, without regard to conflict of law principles.
12. SeverabilityIf any provision of this Warranty is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Entire AgreementThis Warranty constitutes the entire warranty agreement between AquaRev and the Customer with respect to the Device and supersedes all prior or contemporaneous representations or agreements relating to warranty coverage.
